Accepting these terms

These terms are an agreement between your institution and Capabble Platforms LLP ("Capabble", "we"). By creating a workspace account or using Capabble, you accept them on your institution's behalf, and you confirm you're allowed to do that.

If your institution has signed a separate agreement with us, that agreement applies where it differs from these terms.

Your workspace account

  • Each institution has one workspace account. Give accurate details when you create it, including the institution code and affiliation no.
  • Keep passwords private. Everyone at your school should sign in as themselves.
  • Tell us straight away at support@capabble.cloud if you think someone has used an account without permission.
  • You're responsible for what's done through your school's accounts.

Using Capabble properly

Use Capabble only for your institution's work. Don't:

  • Share access with people outside your institution.
  • Upload anything unlawful, or data you don't have the right to use.
  • Try to get around security, test for weaknesses without our written permission, or access other schools' data.
  • Copy, resell or reverse-engineer the software.
  • Send automated traffic that slows the service down for others.

Your school's data

Your institution owns the data it puts into Capabble. You give us permission to store and process it only to provide the service to you, as our privacy policy describes.

You're responsible for having the right to add that data, including any consent needed from parents or guardians for children's data.

Modules, fees and payment

You can use the modules your institution has turned on. Fees are as set out in your order or on our pricing page.

  • Payment terms: billed monthly or yearly in advance, by module and number of students. Invoices are due within 7 days. If an invoice is still unpaid 7 days after it's due, your workspace becomes read-only until it's paid.
  • Prices exclude GST, which is added where it applies.
  • Price changes: we'll give at least 30 days' notice, and a new price applies from your next billing period.

Availability and support

We work to keep Capabble running smoothly. We'll give at least 24 hours' notice of planned maintenance, and schedule it outside school hours where we can. We don't offer an uptime guarantee or service credits.

Support is available through the Help centre and at support@capabble.cloud.

Suspending or closing an account

  • You can close your workspace account at any time from Settings → Account → Close workspace, or by emailing support@capabble.cloud from your administrator's email address.
  • We may suspend an account if these terms are seriously broken or fees are unpaid. We'll give notice first, unless there's an urgent security risk.
  • After an account closes, you can export your school's data for 30 days. After that we delete it within a further 60 days, as our privacy policy describes. Fees already paid aren't refunded.

Our software and brand

Capabble's software, design and brand belong to us. These terms give your institution the right to use Capabble while your account is open. They don't transfer ownership of anything.

If you send us suggestions, we may use them to improve Capabble without owing you anything.

Limits of our liability

We provide Capabble "as is" and "as available". As far as the law allows, we don't promise that it will be uninterrupted or error-free, or that it will suit a particular purpose. Keep your own copies of records you can't afford to lose.

We're not liable for indirect or consequential loss, such as lost profits, lost data that you could have exported, or loss of reputation.

Our total liability for all claims under these terms is limited to the fees your institution paid us in the 12 months before the claim.

Nothing in these terms limits liability that can't be limited by law, such as for fraud.

Governing law

These terms are governed by the laws of India. The courts of Jhajjar, Haryana have jurisdiction over any dispute.

Changes and contact

If we change these terms in a significant way, we'll email workspace account holders at least 30 days before the change takes effect.
